EFTPOS Finder Terms and Conditions

 

 

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the EFTPOS Finder platform (the "Platform"), including all features and functionalities, provided by EFTPOS Finder. By engaging with or using the Platform, you agree to be bound by these Terms which may be modified, and/or updated to better reflect the nature of services provided by the Platform.

 

2. Eligibility

To use the Platform, you must be at least 18 years old and legally capable of entering into a binding contract. By engaging the Platform on behalf of a business entity, you are declaring that you are doing so with the legal authority of that business, and that any binding action made is done so with accurate representation. 

 

3. How EFTPOS Finder Works

EFTPOS Finder facilitates introductions between businesses seeking EFTPOS solutions ("Users") and pre-screened providers of such solutions ("Providers").

Requesting Quotes: Users can request quotes for EFTPOS solutions through the Platform.

Provider Introductions: EFTPOS Finder will introduce interested Users to relevant Providers.

No Cost to Users: Users will not be charged a fee for using the Platform or for receiving quotes from Providers. Providers may pay EFTPOS Finder for services rendered, (including, but not limited to) introductions of businesses seeking EFTPOS solutions.

 

 4. Disclaimer of Service: 

The platform is provided "as is" and "as available" Eftpos finder does not bear responsibility if the platform and its service provided will be uninterrupted, error-free, or secure. By engaging in the platform you are doing so knowing that Eftpos Finder is acting in good faith and would not willingingly mislead the partnerships between users and providers.  

 

5. Acceptable Use

You agree to use the Platform for its intended purpose. You may not:

• Use the Platform in any way that is unlawful, harmful, fraudulent, or deceptive.

• Use the Platform to transmit or distribute any viruses, malware, or other harmful code.

• Interfere with the functioning of the Platform.

• Impersonate any person or entity, or falsely represent your affiliation with any person or entity.

• Collect or use any personal information from other Users without their consent.

• Violate any relevant local, state or federal laws or guidelines
  
   

6. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, and software, is the property of EFTPOS Finder or its licensors and is protected by intellectual property laws. You may not use, reproduce, distribute, or modify any such content without the prior written consent of EFTPOS Finder.

 

7. Third-Party Links

The Platform may contain links to third-party websites. These links are provided for your convenience only and do not constitute an endorsement by EFTPOS Finder of such Third-Party websites. EFTPOS Finder is not responsible for the content, accuracy, or availability of any Third-Party websites.

 

8. Introduction Services

EFTPOS Finder acts solely as an intermediary and does not participate in any agreements or transactions between Users and Providers. Any agreements entered into between Users and Providers are solely between those parties. EFTPOS Finder is not legally responsible or liable for any legally binding actions and/or contracts between users and providers.

8.1

Any personal details and information provided by Users to EFTPOS Finder will be shared with the relevant Provider and can be used by the Provider to communicate with the User. The sharing of details by EFTPOS Finder solely pertains to the specific details shared by the User for the purpose of being connected to the Provider. By sharing your details with EFTPOS Finder you are consenting to being contacted by the Provider and also consent to being opted in to marketing and communications by the Provider.

8.1.1

By submitting information (including personal information) to EFTPOS Finder, you are consenting to being opted-into marketing and communications by EFTPOS Finder.  EFTPOS Finder reserves the right to communicate with Users about other services and/or offers that may be relevant to the User.  Users may, at any point, opt-out of such communication and cease to be contacted by EFTPOS Finder.

 

9. Provider Disputes

EFTPOS Finder is not responsible for resolving any disputes between Users and Providers. If you have a dispute with a Provider, you should attempt to resolve it directly with them.

 

10. Limitation of Liability

In no event shall eftpos finder be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of or inability to use the platform, even if Eftpos finder has been advised of the possibility of such damages.   

 

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia.
